Apply to lease land*, access or a building – not on the market

* (including for access)

Use this form if you are looking to lease land or a building owned by Fife Council, that is not on the market.

Please see the Council’s Land Titles and Assets Map (Property Ownership) to check whether the Council owns the property that you are interested in leasing.

You will be asked to upload:

  • an Ordnance Survey plan or other map and a photograph to identify the land or building.
  • If the location is not obvious from the street address, description and photograph, then please use the link to identify the what3words location.

Minimum costs

The minimum rent to lease land or a building is £500 per annum. Rent will be assessed on a commercial basis and will be subject to five yearly upwards-only rent reviews.

The minimum rent for access is £500 per annum or a minimum grassum (premium) of £5,000 (and a nominal rent of £1 per annum if asked). The rent or grassum will be assessed on a commercial basis.

In addition to the application fee referred to below, a contribution to the Council’s legal and surveying costs and expenses in dealing with the transaction will be required. This could be from £1,200 to £3,000, depending on the transaction. All figures are exclusive of VAT.

The applicant will be responsible for any Land and Buildings Transaction Tax and registration dues arising from the transaction.

Additional Development Value

Please note that, in some cases, the land may have additional development potential. This may be on its own or together with other property. In such cases, an independent valuation will be required and there will be an additional charge for this. You will be advised of this when your application is being considered. The Council may, at any time, decide to offer the property on the open market to ensure that the best value is secured. If this happens, you will have the opportunity to submit an offer.

Cost of application

The fee for this application is £250 and is non-refundable. The costs referred to above are in addition to the application fee. An invoice will be issued following receipt of your application.

Please note that although we will endeavour to provide an initial response within 20 working days, it is dependent on the application fee having been paid.
